Terms and Conditions for Purchases at Ivorie Studio

1. Introduction

These terms and conditions apply to all purchases made on Ivorie Studio’s website. The agreement is entered into with:

By completing a purchase, you agree to the terms and conditions outlined below.

2. Pricing

Norwegian purchases: The total price displayed at checkout includes VAT and any applicable taxes and fees. The amount will be charged at the time of purchase.

International Purchases: For orders outside of Norway, import duties and taxes may apply. These costs are the responsibility of the buyer.

 

3. Governing Law and Dispute Resolution

The agreement is governed by Norwegian law. Any disputes shall be resolved in accordance with Norwegian regulations and can be referred to the Norwegian Consumer Council or settled in Norwegian courts.


4. Payment

The total amount will be charged when the customer completes the purchase. Accepted payment methods include credit cards, debit cards, and other payment options provided at checkout.

5. Delivery

Delivery is considered completed when the goods are made available for the customer to pick up or are delivered to the specified address. For Norwegian customers, delivery follows Norwegian consumer protection laws.

6. Returns and Right of Withdrawal

You have the right to cancel your purchase within 15 days of receiving the goods, in accordance with the Norwegian Consumer Purchase Act.

• The item must be returned unused and in its original condition.
• The customer must notify Ivorie Studio of the return before sending the goods.
• If the item is not returned in its original condition, a reduction in the refund amount may apply.

7. Defects in Goods – Buyer’s Rights and Complaint Deadlines

If there is a defect in the product, the buyer must notify the seller within a reasonable time after the defect was discovered or should have been discovered. The buyer always has the right to complain if the notification is sent within two months of discovering the defect.


If the product has a defect that is not caused by the buyer, the buyer may, under applicable consumer protection laws:

Demand repair or replacement

Request a price reduction

Cancel the purchase (if the defect is significant)

Claim compensation for damages caused by the defect


Repair or Replacement:

The buyer may choose to have the defect repaired or receive a replacement product. However, the seller may refuse the request if fulfilling it is impossible or would cause unreasonable costs for the seller.


Price Reduction:

The buyer may request a price reduction if the product is not repaired or replaced within a reasonable time. The reduction should reflect the difference between the product’s value in its defective state and its value in proper condition.


Cancellation:

If the product is neither repaired nor replaced, the buyer may cancel the purchase if the defect is significant.


Complaints must be submitted in writing to the seller for documentation purposes.

8. Seller’s Rights in Case of Buyer’s Breach of Contract

If the buyer fails to pay or fulfill their obligations under the agreement or applicable laws, and this is not due to the seller or circumstances on the seller’s side, the seller may:

Retain the goods

Demand fulfillment of the agreement

Cancel the agreement

Claim compensation for damages caused by the breach


The seller may also demand interest for delayed payments, debt collection fees, and reasonable fees for unclaimed goods.


Fulfillment:

The seller may demand that the buyer pay the purchase price. If the goods have not been delivered, the seller loses this right if they wait unreasonably long to make the claim.


Cancellation:

The seller may cancel the agreement in the event of significant payment default or other significant breaches by the buyer. If the full purchase price has already been paid, cancellation is not possible.


Interest and Debt Collection Fees:

If the buyer fails to pay, the seller may charge interest on the overdue amount in accordance with applicable laws. Unpaid claims may be sent to debt collection after prior notice.


Fees for Unclaimed Goods:

If the buyer fails to collect non-prepaid goods, the seller may charge a fee to cover actual expenses incurred.



9. Data Protection

The seller is responsible for managing personal data collected during transactions. Unless otherwise agreed by the buyer, the seller will only collect and store the personal data necessary to fulfill their obligations under the agreement. Personal data will not be shared with third parties unless required to complete the transaction or mandated by law.

10. Dispute Resolution

Complaints should be directed to the seller within a reasonable time. The parties will attempt to resolve any disputes amicably. If this is not possible, disputes can be referred to the Norwegian Consumer Council for mediation or settled in Norwegian courts.
